Criminal complaint calling for the investigation of 147 cases of illegal, violent, racist pushback or deportation of 7000+ foreigners in March-December 2020

Mr Prosecutor

Greek Helsinki Monitor (GHM), in the framework of its project  Racist Crimes Watch, has recorded 147 incidents of illegal, violent, racist pushback (at sea) or deportation (from the islands or from the mainland) during the period March – December 2020 with more than 7000 foreign victims. The recording was made mainly on the basis of published material from media and NGOs. All this has been collected on the website of Racist Crimes Watch and on the Youtube channel. Below is the recording of incidents with hyperlinks to web pages and to videos. 

With this complaint we request the criminal investigation of the 147 incidents of illegal, violent, racist pushback (at sea) or deportation (from the islands or from the mainland). The result of the investigation will be included in the reports submitted and in the briefings carried out regularly by GHM to the competent bodies of the UN, the Council of Europe and the EU, to which the present complaint will be copied after translation.

We request the exclusion of the Prosecutor’s Office of the Athens Naval Court from the judicial investigation due to the denial of justice and bias with which he handled the previous “Criminal complaint for serial illegal pushbacks of foreigners March – July 2020” that we submitted to you on 27 August 2020. You gave it protocol number 6878/2020. You forwarded it to the Athens Prosecutor’s Office on 31 August 2020, which simply forwarded it to the Athens Naval Court Prosecutor’s Office on 18 September 2020. The latter, as they informed us, did not conduct any preliminary examination but simply correlated it with a case file for 1 of the 32 events (denial of justice). Besides, he archived this case file, as well as another one, indiscriminately adopting the positions given to him by the defendant Hellenic Coast Guard without taking any other testimonies (bias).

The pushbacks have exposed and dragged Greece through the mud internationally for more than a year. We request the Prosecutor of the Supreme Court to take the necessary steps to ensure their effective, independent and substantive investigation, which will restore the prestige of the rule of law in the country.
