The action of Constantine Mitsotakis – Prime Minister and George Florides – Minister of Justice object of the complaint

On March 28, 2023, Prime Minister Konstantinos Mitsotakis tabled to Parliament the «Response of the Greek Government to the 7.2.2024 Resolution of the European Parliament on the State of Rule of Law in Greece» signed by the Minister of Justice George Floridis and attached as it has been included in the archives of the Parliament which is indicated on the upper right part of the first page and apparently sent to the European Parliament. On pages 11 and 12 is the following text:

Given that I was never arrested on Kos (nor anywhere else, nor at any other time), the reference by Prime Minister Constantine Mitsotakis and Justice Minister George Floridis that «I was arrested on Kos» is completely false and obviously intended and intends to slander me before the Parliament and the European Parliament.

In addition, apart from the charges invoked by the Government (which are based on illegally obtained evidence), the relevant case file contains a sworn deposition before the Investigating Judge by the Head of the Refugee Protection Unit at the UNHCR Greece, with whom the Greek Helsinki Monitor (GHM) cooperates, which describes the correctness of my actions: «The most common cases of contact between migrants and NGO members before they enter the country have to do with providing legal assistance in cases of …possible support for refugees who have suffered violations of their rights, for example there are complaints from refugees who claim that they have been involuntarily returned from Greece to Turkey. These individuals may request legal assistance from organizations in Greece in order to support them in the investigation of the complaint. I am not aware of any cases of NGO members assisting migrants to enter the country.»

There is also an a sworn deposition before the Investigating Judge of the Deputy Ombudsman in the Independent Authority «Greek Ombudsman» which also describes the correctness and indeed the completeness of my actions in cases of arrivals of foreigners in Greece who wish to seek asylum «Mr Dimitras, as Spokesperson of the Greek Helsinki Monitor, sends his reports to the Ombudsman and the Competent Authorities as he is aware of the procedure. Because, for example, other NGOs dealing with the same issue of refugees merely notify the Ombudsman and as a result, we cannot, by law, examine these reports. We… when we receive the reports of Mr Dimitras, what we do is to forward them to the competent authorities, asking for their legal actions, informing Mr Dimitras about them. In these reports, he records the names of the refugees and where in the country they are, primarily addressing the competent authorities for their legal actions and at the same time the Ombudsman to monitor the actions of the Administration. Sometimes the Authorities reply that the persons mentioned in his report have been found, sometimes they reply in the negative.»

The Government should have taken into account these two testimonies of senior representatives of UN and Greek institutions in its response to the European Parliament, which it also submitted to Parliament, so that instead of misinforming and misleading the two Parliaments with the slander about my alleged «arrest» at least to maintain a neutral position in a pending court case and not to construct a slander with the aim of misinforming and misleading the European Parliament and the Parliament and influencing the Greek Justice

FOR THESE REASONS I FILE A COMPLAINT AGAINST

The aforementioned action of the Prime Minister Constantine Mitsotakis and the Minister of Justice George Floridis, which constitutes an act of breach of duty and aggravated defamation, as well as a violation of Article 18 ECHR («Limitation on use of restrictions on rights») since, based on the aforementioned, they knowingly made a false and defamatory reference to Panayote Dimitras, thus with intent they breached their official duties with the sole purpose of harming Panayote Dimitras and they alleged about Panayote Dimitras a false «fact» which may and aimed to harm his honor or reputation and they knew that this was false.

I declare that I stand in support of the accusation for the moral damage suffered by me as a result of the aforementioned unlawful act and conduct of the defendants.
