«Να τερματιστεί η δικαστική παρενόχληση του Παναγιώτη Δημητρά»

Τι αναφέρει το Παρατηρητήριο για την Προστασία των Υπερασπιστών Ανθρωπίνων Δικαιωμάτων

Άλλη μια δικαστική αθώωση του Παναγιώτη Δημητρά, εκπροσώπου της οργάνωσης Ελληνικό Παρατηρητήριο των Συμφωνιών του Ελσίνκι, χαιρετίζει με σημερινή του ανακοίνωση το Παρατηρητήριο για την Προστασία των Υπερασπιστών των Ανθρωπίνων Δικαιωμάτων, που λειτουργεί με συνεργασία της Διεθνούς Ομοσπονδίας για τα Ανθρώπινα Δικαιώματα (FiDH) και του Παγκόσμιου Οργανισμού κατά των Βασανιστηρίων (OMCT).

Η υπόθεση αφορά τις κατηγορίες της ψευδούς καταμήνυσης και της συκοφαντικής δυσφήμισης για τα οποία είχε μηνύσει τον κ. Δημητρά ο πρώην δήμαρχος Μαντουδίου -Λίμνης -Αγίας Άννας Χρήστος Καλυβιώτης. Ο υπερασπιστής ανθρωπίνων δικαιωμάτων είχε χαρακτηρίσει ρατσιστικές τις δηλώσεις του δημάρχου στις 13 Δεκεμβρίου 2018, με τις οποίες, σύμφωνα με τον ίδιο, εξίσωνε πρόσφυγες με εγκληματίες. Ο κ. Δημητράς είχε υποβάλει μήνυση για παραβίαση του αντιρατσιστικού νόμου, η οποία όμως αρχειοθετήθηκε, και στη συνέχεια είχε μηνυθεί από το δήμαρχο, ο οποίος υπέβαλε τον περασμένο Φεβρουάριο και αγωγή με τις ίδιες κατηγορίες. Στις 17 Απριλίου, το Δικαστήριο απάλλαξε τον κ. Δημητρά από τις κατηγορίες στο ποινικό σκέλος της υπόθεσης.

Το Παρατηρητήριο θυμίζει και άλλες περιπτώσεις στις οποίες κατηγορείται ο υπερασπιστής ανθρωπίνων δικαιωμάτων, που αντιμετωπίζει σειρά αγωγών στρατηγικού χαρακτήρα για την παρεμπόδιση της συμμετοχής στα κοινά, τις γνωστές αγωγές SLAPP, ενώ θυμίζει τη δίωξη εναντίον του με εξωφρενικές κατηγορίες επειδή βοήθησε πρόσφυγες να ζητήσουν άσυλο στην Ελλάδα και το πάγωμα των λογαριασμών της οργάνωσής του.

«Το Παρατηρητήριο χαιρετίζει την αθώωση του Παναγιώτη Δημητρά και τον τερματισμό της δικαστικής παρενόχλησης εναντίον του σε σειρά υποθέσεων SLAPP αλλά σημειώνει ότι δεν θα έπρεπε ποτέ να έχει διωχτεί αρχικά, καθώς η δικαστική παρενόχληση στόχευε μόνο στην τιμωρία του για τις θεμιτές δραστηριότητές του για τα ανθρώπινα δικαιώματα», σημειώνει το Παρατηρητήριο.

Προσθέτει: «Το Παρατηρητήριο εκφράζει ανησυχία για τη συνεχιζόμενη δικαστική παρενόχληση του Παναγιώτη Δημητρά και καλεί επειγόντως τις ελληνικές αρχές να σεβαστούν τα δικαιώματά του σε κατάλληλη διαδικασία και δίκαιη δίκη και να διασφαλίσουν ότι θα τερματιστούν όλες οι ενέργειες παρενόχλησης εναντίον του, συμπεριλαμβανομένης της παρενόχλησης σε δικαστικό επίπεδο, όπως και εναντίον όλων των υπερασπιστών ανθρωπίνων δικαιωμάτων στη χώρα».

The Observatory for the Protection of Human Rights Defenders, a partnership of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your intervention in the following situation in Greece.

• New information:

The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the acquittal of minority rights defender Mr. Panayote Dimitras. Mr. Dimitras is the GHM co-founder and spokesperson, and member of the OMCT’s General Assembly.

On April 17, 2024, the Three-Member Misdemeanours Court of Athens acquitted Panayote Dimitras after five years of judicial harassment. He was prosecuted under criminal charges of “false accusation” and “aggravated defamation” (Articles 229 and 363 of the Criminal Code of Greece, respectively) for having denounced racist comments from a public official.

The Observatory recalls that the trial against Mr. Dimitras was related to a complaint of “violating the Law on Combatting Racism and Xenophobia” he filed in December 2018 before the Department for Combating Racist Violence (Attica Division) of the Hellenic Police against Mr. Christos Kalyviotis, then Mayor of Limni – Mantoudi – Agia Anna. According to Mr. Dimitras’ complaint, Mr. Kalyviotis equated asylum seekers and refugees to criminals in a statement from December 13, 2018. The complaint was however dismissed and archived by the Prosecutor on July 4, 2019. On April 22, 2019, Mr. Kalyviotis filed an oral complaint at a local police station for “false accusation” and “aggravated defamation” against Panayote Dimitras. The complaint was transferred to the Public Prosecutor’s Office at the Athens Court of First Instance on July 16, 2019, and a preliminary investigation was opened on January 8, 2020.

In addition, on February 16, 2024, Mr. Dimitras was notified that Mr. Kalyviotis had filed a lawsuit against him at the civil level in relation to the same facts, for “aggravated defamation” (Article 57 of the Greek Civil Code). Mr. Dimitras was given 90 days to present his arguments before the Single-Judge First Instance Court of Athens sets a hearing date.

The Observatory recalls that the procedure initiated by Mr. Kalyviotis is only one out of many abusive criminal proceedings brought against Panayote Dimitras over the past few years and constitutive of strategic lawsuits against public participation (SLAPPs).

On March 13, 2024, the Three-Member Misdemeanours Court of Athens eventually put an end to the prosecution of Mr. Dimitras under similar charges of “false accusation” and “aggravated defamation”, resulting from the complaint filed in February 2019 by Mr. Kostas Katsikis, then Member of the Greek Parliament for the extreme-right party Independent Greeks. Mr. Dimitras had filed a complaint against him in November 2017 for “public incitement to violence or hatred” after Mr. Katsikis allegedly made a racist, homophobic, and transphobic speech during a parliamentary debate on December 12, 2016. On March 13, 2024, the Three-Member Misdemeanours Court of Athens declared the nullity of the writ of summons due to a procedural mistake and dropped the charges against Mr. Dimitras.

On June 16, 2023, the Athens Court of Appeal acquitted Panayote Dimitras and his colleague Ms. Andrea Gilbert, GHM specialist on anti-Semitism, following a similar case. On February 15, 2022, Mr. Dimitras and Ms. Gilbert had been sentenced in first instance to a twelve-month prison sentence suspended for three years on the charge of “false accusation” in relation to a complaint for “public incitement to violence or hatred” and “abuse of ecclesiastical office” they had filed in April 2017 against the Metropolitan Bishop of Piraeus Seraphim.

In other instances, Mr. Dimitras saw similar charges dropped by the Three-Member Misdemeanours Court of Athens before facing trial. On June 8, 2023, the Three-Member Misdemeanours Court of Athens granted Mr. Dimitras’ appeal against his referral to trial and dropped the charges of “false accusation” and “aggravated defamation” brought against him by a police officer after Mr. Dimitras had filed a complaint against him in relation with a homophobic statement.

On February 3, 2023, the Three-Member Misdemeanours Court of Athens had granted Mr. Dimitras’ appeal against his referral to trial following another complaint for “false accusation” and “aggravated defamation” filed by musician and actor Mr. Yannis Zouganelis on March 26, 2019. The proceedings were related a complaint filed in December 2018 by Mr. Dimitras against Mr. Zouganelis following racist comments against Greece-based migrants in a statement he made on TV on December 19, 2018.

However, Panayote Dimitras is still facing another trial in relation to a complaint he filed in 2021 against extreme-right leader Mr. Failos Kranidiotis, following the publication of a tweet in which he called all refugees “illegal plunderers”. As a result, Mr. Kranidiotis filed a civil lawsuit against Mr. Dimitras for “alleged insult” and requested 120,000 Euros for moral damage. On October 20, 2023, an Athens Multi-Member First Instance Court ruled that the complaint of Mr. Dimitras was constitutive of an insult under Article 57 of the Greek Civil Code and awarded Mr. Kranidiotis 3,000 Euros for moral damage and 500 Euros for court expenses when the judgment becomes final. Mr. Dimitras has appealed the judgement, and a hearing is scheduled before the Athens Court of Appeal for October 24, 2024. It is worth noting that in this case, Twitter removed the litigious tweet for hateful content.

Moreover, Mr. Dimitras is facing further judicial harassment for having provided humanitarian assistance to asylum seekers, resulting in severe preventive measures including a ban on carrying out any of GHM’s activities and the freezing of all his assets. While the European Parliament has expressed its concern over these measures and Mr. Dimitras’ prosecution “for illegal trafficking, even though it appears that he was acting lawfully to provide humanitarian assistance to asylum seekers” in its resolution of February 7, 2024 on the rule of law and media freedom in Greece (2024/2502(RSP)), the responses provided by the Supreme Court and the Greek government to the resolution are of particular concern and seem to constitute both smear campaigns against Mr. Dimitras as well as violations to his right to a fair trial.

The Observatory welcomes the acquittal of Panayote Dimitras and the end of the judicial harassment against him in the various SLAPP cases against him but recalls that he should have never been prosecuted in the first place, as this judicial harassment was only aimed at punishing him for his legitimate human rights activities.

The Observatory recalls that on February 27, 2024, the European Parliament adopted the anti-SLAPP Directive in its first reading, and while it has not entered into force yet, the Observatory encourages the Greek authorities to start preparing for its effective implementation to protect human rights defenders from abusive proceedings.

The Observatory expresses concern over the continuing judicial harassment of Panayote Dimitras and urges the Greek authorities to respect his rights to due process and fair trial, and to ensure that an end is put an to all acts of harassment, including at the judicial level, against him, as well as all other human rights defenders in the country.

Actions requested:

Please write to the authorities of Greece, urging them to:

i. Guarantee, in all circumstances, the physical integrity and psychological well-being of Panayote Dimitras and all other human rights defenders in Greece;

ii. Ensure that an immediate end is put to all act of harassment, including at the judicial level, against Panayote Dimitras and Andrea Gilbert, as well as against all human rights defenders in Greece.

Greece: International experts to observe appeal hearing of two human rights defenders criminalised by the authorities

The Observatory for the Protection of Human Rights Defenders, a partnership of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), will observe today the appeal hearing of Mr Panayote Dimitras and Ms Andrea Gilbert, Spokesperson of the Greek Helsinki Monitor (GHM) and GHM specialist on anti-Semitism, respectively, at the Athens Court of Appeal in Greece.

Paris, Geneva, 16 June 2023. Human rights defenders, particularly those who denounce hate speech and work for the protection and defence of minorities, migrants, refugees, and asylum seekers’ rights, are subjected to severe criminalisation and judicial harassment in Greece. Mr Dimitras and Ms Gilbert are two among them. On 15 February 2022, the Three-Member Misdemeanours Court of Athens imposed them a twelve-month prison sentence suspended for three years on the charge of “false accusation” (Article 229 of the Criminal Code of Greece). They appealed this decision, and the Athens Court of Appeal will hear the case today, 16 June 2023. Two Observatory representatives will observe the hearing.

“The Greek Helsinki Monitor and its members have been under the authorities’ radar for more than a decade simply for exercising their right to defend human rights. Their targeting is not an isolated incident but part of a wider context of criminalisation and harassment against human rights defenders in the country,” said Gerald Staberock, OMCT Secretary General.

The judicial procedure against both human rights defenders is related to a complaint for “public incitement to violence or hatred” and “abuse of ecclesiastical office” they filed in April 2017 before the Department for Combating Racist Violence (Attica Division) of the Hellenic Police against the Metropolitan Bishop of Piraeus Seraphim. According to GHM’s complaint, the content of a public statement the Bishop made on 27 April 2017, was antisemitic and incited discrimination, hatred, or violence against Jewish people in a way that endangered public order or posed a threat to lives, liberty of physical integrity. Nonetheless, while the Greek authorities archived the complaint, the public prosecutor brought the charge of “false accusation” against Mr Dimitras and Ms Gilbert and referred them to trial without previously investigating, as prescribed by law. The prosecutor framed the Metropolitan Bishop of Piraeus Seraphim’s statements as “part of the Church doctrine”.

“The systematic harassment of human rights defenders, and particularly of defenders of the rights of minorities and migrants in Greece, is indefensible. We call for all cases against the Greek Helsinki Monitor and its associates to be immediately closed, and on the authorities to guarantee an enabling environment for the defense of human rights”, said Alice Mogwe, FIDH President.

In fact, since November 2022, Panayote Dimitras faces serious criminal charges in a separate case as reprisals for his work defending migrants’ rights. This takes place in a context of systematic violations of international human rights standards by the Greek authorities, including illegal pushbacks and collective expulsions of migrants. As the investigations into Dimitras’ legitimate human rights activities are ongoing, he has been imposed several restrictive and disproportionate measures, which include a travel ban, a duty to report to the police twice a month, a €10,000 bail, and a prohibition to work with the GHM and to carry out any activity on behalf of the organisation. Recently some Greek media published leaked information about an alleged asset freeze imposed on him and his organisation. To date, Dimitras has not received any official notification.

The Observatory urges the Greek authorities to guarantee and comply with internationally recognised human rights standards of fair trial and due process and to fully adhere to and respect the United Nations Declaration on Human Rights Defenders.

Με συμμετοχή διεθνών παρατηρητών, την Παρασκευή 16 Ιουνίου 2023, στο Β’ Τριμελές Εφετείο Πλημμελημάτων Αθηνών (2ος όροφος – αίθουσα Δ80Β – μετά τις 11πμ) εκδικάζεται η έφεση των Παναγιώτη Δημητρά και Andrea Gilbert κατά της καταδίκης τους στις 15 Φεβρουαρίου 2022 από το Α’ Τριμελές Πλημμελειοδικείο Αθηνών για ψευδή καταμήνυση κατά συναυτουργία του Μητροπολίτη Πειραιώς Σεραφείμ και της επιβολής σε αυτούς ποινής 12 μηνών με αναστολή, με το σκεπτικό που επισυνάπτεται παρακάτω.

ΑΝΑΚΟΙΝΩΣΗ ΤΟΥ ΚΙΣΕ ΓΙΑ ΤΟ ΑΝΑΚΟΙΝΩΘΕΝ ΤΟΥ ΜΗΤΡΟΠΟΛΙΤΗ ΠΕΙΡΑΙΩΣ

Για άλλη μια φορά δεν μας εκπλήσσει το νέο παραλήρημα (εδώ σε pdf) του Μητροπολίτη Πειραιώς κ. Σεραφείμ που αναρτήθηκε στο επίσημο ιστολόγιο της Μητρόπολης Πειραιά. Παρά τις φιλότιμες προσπάθειές του να αποσείσει τις κατηγορίες για αντισημιτισμό, στο μακροσκελές κείμενό του έχει βαφτίσει τον αντισημιτισμό ως αντισιωνισμό χρησιμοποιώντας γνωστά αντισημιτικά στερεότυπα, τη συνωμοσιολογία και την παραδοσιακή εβραιοφοβία, προκειμένου να μην χαρακτηρισθεί ως αντισημίτης αλλά ως αντισιωνιστής. 

Πιστεύουμε ότι οι δηλώσεις του δεν συνάδουν ούτε με την ιδιότητα του ιεράρχη της Ελληνικής Ορθόδοξης Εκκλησίας, που ευαγγελίζεται την αγάπη και την αλληλεγγύη, ούτε με εκείνη του κρατικού λειτουργού που οφείλει να τηρεί το Σύνταγμα και τους νόμους του κράτους.

Είμαστε βέβαιοι ότι θα συμφωνήσει ο Μακαριώτατος Αρχιεπίσκοπος κ. Ιερώνυμος ότι η εκστρατεία μίσους εναντίον του Εβραϊκού λαού δεν συνάδει ούτε με τις αρχές ούτε και με την ιστορία της Ελληνικής Ορθόδοξης Εκκλησίας.   

Το Κεντρικό Ισραηλιτικό Συμβούλιο Ελλάδος ζητά από τον Μακαριώτατο Αρχιεπίσκοπο κ. Ιερώνυμο και την Ιεραρχία της Ελληνικής Ορθόδοξης Εκκλησίας να απομονώσουν τις ακραίες ρατσιστικές και αντισημιτικές απόψεις που κυκλοφορούν στους κόλπους της Εκκλησίας, οι οποίες δηλητηριάζουν την Ελληνική κοινωνία και υπονομεύουν την αρμονική συνύπαρξη όλων των Ελλήνων πολιτών, ανεξαρτήτως φύλου, χρώματος ή θρησκεύματος.

Ελλάδα: Δικαστική παρενόχληση των υπερασπιστών δικαιωμάτων των μεταναστών Παναγιώτη Δημητρά και Tommy Olsen

Παναγιώτη Δημητρά και του κ. Tommy Olsen ως αντίποινα για το έργο τους υπερασπίζοντας τα δικαιώματα των μεταναστών. Ο κ. Δημητράς είναι ο συνιδρυτής και εκπρόσωπος του ΕΠΣΕ και μέλος της Γενικής Συνέλευσης του OMCT. Ο κ. Olsen είναι ο ιδρυτής της Aegean Boat Report, μιας Νορβηγικής ΜΚΟ που ιδρύθηκε το 2018 και παρακολουθεί τις προσπάθειες μεταναστών να διασχίσουν το Αιγαίο Πέλαγος, καθώς και τις παραβιάσεις των ανθρωπίνων δικαιωμάτων που διαπράττονται εναντίον τους, συμπεριλαμβανομένων των παράνομων επαναπροωθήσεων. Στις 20 Δεκεμβρίου 2022, ο Παναγιώτης Δημητράς εμφανίστηκε για ανάκριση ενώπιον της Ανακρίτριας του Πρωτοδικείου Κω στο πλαίσιο ποινικής δικογραφίας που σχηματίστηκε σε βάρος του. Κατηγορείται για «σύσταση ή ένταξη σε εγκληματική οργάνωση κατ’ επάγγελμα με σκοπό το κέρδος  και στόχο  τη διευκόλυνση της παράνομης εισόδου και παραμονής στην Ελλάδα πολιτών τρίτων χωρών» σύμφωνα με τα άρθρα 1, 12, 13(e), 14, 16, 17. 18, 26(a), 27, 45, 50, 51, 52, 53, 57, 79, 80, 94, 187 παράγρ. 1 του Ν. 4251/2014, που ονομάζεται και Κώδικας Μετανάστευσης και Κοινωνικής Ένταξης. Στον Παναγιώτη Δημητρά έχει απαγορευτεί να ασκήσει οποιαδήποτε από τις δραστηριότητες του ΕΠΣΕ ως περιοριστικό μέτρο εν αναμονή της δίκης. H Εισαγγελέας ζήτησε επιπλέον κατ’ οίκον περιορισμό για τον κ. Δημητρά, ενώ η Ανακρίτρια πρότεινε απαγόρευση εξόδου από τη χώρα, εγγύηση 10.000 ευρώ και δεκαπενθήμερη εμφάνιση στην αστυνομία. Το Δικαστικό Συμβούλιο θα αποφασίσει ποια από τα υπόλοιπα προληπτικά μέτρα που θα επιβληθούν στον κ. Δημητρά τις επόμενες ημέρες. Η Ανακρίτρια της Κω ξεκίνησε ανάκριση για τις δραστηριότητες του κ. Tommy Olsen για τα ανθρώπινα δικαιώματα στο πλαίσιο της ίδιας ποινικής δικογραφίας. Το κατηγορητήριο που εξέδωσε η Ανακρίτρια της Κω κατά του Παναγιώτη Δημητρά αναφέρει ότι ο Tommy Olsen «διευκόλυνε την είσοδο και διαμονή υπηκόων τρίτων χωρών στην ελληνική επικράτεια» σε συνεργασία με τον κ. Δημητρά και δύο φερόμενους ως διακινητές ανθρώπων. Το κατηγορητήριο αναφέρει περαιτέρω ότι ο κ. Olsen είχε στείλει «μήνυμα μέσω e-mail στις ελληνικές αρχές, συμπεριλαμβανομένων των στοιχείων των πολιτών τρίτων χωρών, καθώς και της τοποθεσίας τους, προκειμένου να ενταχθούν στις διαδικασίες ασύλου». Κατά τη δημοσίευση αυτής της Επείγουσας Έκκλησης, ο Tommy Olsen δεν είχε λάβει καμία επίσημη ενημέρωση σχετικά με τις ποινικές έρευνες και τις υποθέσεις που κινήθηκαν εναντίον του. Οι κατηγορίες αυτές σχετίζονται με τις επείγουσες ειδοποιήσεις του κ. Δημητρά προς την Ελληνική Αστυνομία, το Λιμενικό Σώμα, τις ελληνικές μεταναστευτικές αρχές, την Ύπατη Αρμοστεία του ΟΗΕ για τους Πρόσφυγες στην Ελλάδα και το Συνήγορο του Πολίτη για άφιξη μεταναστών στα ελληνικά νησιά Κω στις 13 Ιουλίου 2021. Ο κ. Δημητράς έστειλε πολλά e-mail στις προαναφερθείσες αρχές με τα ονόματα και την εθνικότητα των μεταναστών που ταξίδευαν με πλωτά σκάφη προς την Ελλάδα προκειμένου να υποβάλουν αίτημα ασύλου. Στα e-mail του ο κ. Δημητράς ανέφερε ρητά ότι οι μετανάστες είχαν επικοινωνήσει με το ΕΠΣΕ για να ειδοποιήσουν την οργάνωση για την κατάστασή τους, δηλαδή την παρουσία τους στα νησιά, καθώς και την επιθυμία τους να αιτηθούν άσυλο. Η δικογραφία περιλαμβάνει λεπτομέρειες σχετικά με το αίτημα της Ανακρίτριας της Κω προς τον Ανακριτή της Λέσβου να παράσχει πληροφορίες σχετικά με μια δεύτερη ποινική έρευνα κατά του Tommy Olsen, καθώς και των εργαζομένων στον τομέα της ανθρωπιστικής φροντίδας και της υγειονομικής περίθαλψης κυρίας Madi Williamson και κυρίας Ruhi Loren Akhtar, για « διευκόλυνση της παράνομης εισόδου αλλοδαπών στην Ελληνική επικράτεια μέσω των βορειοανατολικών νησιών του Αιγαίου Πελάγους». Κανείς από αυτούς δεν έχει ενημερωθεί επίσημα γι’ αυτή την υπόθεση. Το Παρατηρητήριο υπενθυμίζει ότι στις 10 Οκτωβρίου 2022, η μεγαλύτερη εθνική εφημερίδα της Ελλάδας Καθημερινή δημοσίευσε πληροφορίες που διέρρευσαν για δύο ποινικές έρευνες και επακόλουθες ποινικές υποθέσεις που φέρονται να σχηματίστηκαν εναντίον του Παναγιώτη Δημητρά και «υπηκόου Βορειοευρωπαϊκής χώρας» με την κατηγορία της «διευκόλυνσης εισόδου υπηκόων τρίτων χωρών στην Ελληνική επικράτεια» σύμφωνα με τον Νόμο 4251/2014. Το άρθρο δεν ανέφερε ρητά το όνομα του κ. Δημητρά, αλλά χρησιμοποιούσε αόριστους όρους για να τον ταυτοποιήσει, μεταξύ των άλλων «επικεφαλής ΜΚΟ για τα ανθρώπινα δικαιώματα» ή «Έλληνας επικεφαλής της ΜΚΟ». Σύμφωνα με την εφημερίδα, οι έρευνες ξεκίνησαν από το Λιμενικό Σώμα από κοινού με την Εθνική Υπηρεσία Πληροφοριών και στη συνέχεια υποβλήθηκαν «στην αρμόδια εισαγγελία». Το δημοσίευμα ανέφερε ακόμη ότι οι δύο ποινικές υποθέσεις βρίσκονται στα χέρια της Ανακρίτριας στην πόλη της Κω. Ο Παναγιώτης Δημητράς δεν έλαβε καμία επίσημη ενημέρωση για την ποινική έρευνα και τη δικογραφία που κινήθηκε εναντίον του μέχρι τις 18 Νοεμβρίου 2022 και του δόθηκε πρόσβαση στη δικογραφία μόλις στις 9 Δεκεμβρίου 2022. Το Παρατηρητήριο καταδικάζει σθεναρά τις δικαστικές εκστρατείες δίωξης και συκοφαντικής δυσφήμισης κατά των Παναγιώτη Δημητρά, Tommy Olsen, Madi Williamson, Ruhi Loren Akhtar και όλων των υπερασπιστών των δικαιωμάτων των μεταναστών στην Ελλάδα, καθώς και τη συνεχιζόμενη παραβίαση των δικαιωμάτων των μεταναστών και την επακόλουθη έκθεσή τους σε βασανιστήρια και κακομεταχείριση στο πλαίσιο συλλογικών και παράνομων απελάσεων. Οι μη κυβερνητικές οργανώσεις που εργάζονται για τα δικαιώματα των μεταναστών διαδραματίζουν ουσιαστικό ρόλο για την υπεράσπιση των ανθρωπίνων δικαιωμάτων των ανθρώπων που μετακινούνται σε ένα πλαίσιο συστηματικών παραβιάσεων των διεθνών προτύπων ανθρωπίνων δικαιωμάτων από τις ελληνικές αρχές, συμπεριλαμβανομένων των παράνομων επαναπροωθήσεων και ομαδικών απελάσεων μεταναστών, όπως καταγγέλθηκε το 2020 από την Επιτροπή Κατά των Βασανιστηρίων του ΟΗΕ (UNCAT). Το ελληνικό κράτος απέτυχε συστηματικά να υποβάλλει τις πληροφορίες σχετικά με τον φερόμενο εκφοβισμό και τη δίωξη υπερασπιστών των ανθρωπίνων δικαιωμάτων και εργαζομένων ανθρωπιστικών οργανώσεων και εθελοντών που απαιτούνταν από την UNCAT. Ωστόσο, οι υπερασπιστές των δικαιωμάτων των μεταναστών έχουν ποινικοποιηθεί σε μεγάλο βαθμό εδώ και χρόνια. Έχουν στοχοποιηθεί συνεχώς για το νόμιμο έργο τους και έχουν αντιμετωπίσει διαφορετικούς τύπους επιθέσεων, όπως παρακολούθηση, δικαστική δίωξη, εκστρατείες συκοφαντικής δυσφήμισης, απαγορεύσεις εισόδου και απέλαση από τη χώρα. Οι Ελληνικές ανακριτικές αρχές συχνά διαρρέουν στα μέσα ενημέρωσης φερόμενες ποινικές έρευνες που ξεκίνησαν εναντίον υπερασπιστών των δικαιωμάτων των μεταναστών, δημιουργώντας κλίμα φόβου και ανατριχιαστική επίδραση μεταξύ όλων των υπερασπιστών των δικαιωμάτων, όπως τεκμηριώνεται από το Παρατηρητήριο στην έκθεσή του για το 2021 «Europe: Open Season on Solidarity». Σε πολλές από αυτές τις περιπτώσεις, οι υπερασπιστές των ανθρωπίνων δικαιωμάτων δεν έχουν ενημερωθεί ούτε κληθεί να καταθέσουν. Το Παρατηρητήριο καλεί τις Ελληνικές αρχές να τερματίσουν αμέσως τη δίωξη, περλαιμαβνόμενης και της δικαστικής διωξης, κατά των Παναγιώτη Δημητρά, Tommy Olsen, Madi Williamson, Ruhi Loren Akhtar καθώς και όλων των ΜΚΟ και εθελοντών που εργάζονται στη χώρα στον τομέα της ανθρωπιστικής βοήθειας σε μετανάστες και αιτούντες άσυλο. Το Παρατηρητήριο καλεί περαιτέρω τις αρχές να εγγυηθούν σε όλες τις περιστάσεις ότι είναι σε θέση να ασκήσουν τα νόμιμα ανθρώπινα δικαιώματα και τις ανθρωπιστικές δραστηριότητές τους χωρίς φόβο ανταπαντήσεων. Πώς μπορείτε να βοηθήσετε: Παρακαλούμε γράψτε στις αρχές της Ελλάδας, ζητώντας τους: 1. Να εγγυηθούν, σε κάθε περίπτωση, τη σωματική ακεραιότητα και την ψυχική ευεξία των Παναγιώτη Δημητρά, Tommy Olsen, Madi Williamson, Ruhi Loren Akhtar, καθώς και όλων των υπερασπιστών των ανθρωπίνων δικαιωμάτων στην Ελλάδα. 2. Να θέσουν άμεσο τέλος σε όλες τις πράξεις δίωξης, συμπεριλαμβανομένου του δικαστικού επιπέδου, κατά των Παναγιώτη Δημητρά, Tommy Olsen, Madi Williamson, Ruhi Loren Akhtar και να εγγυηθούν τα δικαιώματά τους για δίκαιη διαδικασία και δίκαιη δίκη κατά τη διάρκεια της δικαστικής διαδικασίας στις υποθέσεις τους. 3. Να αυξήσουν την ευαισθητοποίηση και να εκπαιδεύσουν τους δικαστικούς λειτουργούς ώστε να αποφεύγουν να εφαρμόζουν νόμους που έχουν σχεδιαστεί για την καταπολέμηση του οργανωμένου εγκλήματος σε βάρος υπερασπιστών των ανθρωπίνων δικαιωμάτων, οργανώσεων ή και κατά των ίδιων των μεταναστών· 4. Να εφαρμόσουν τη Σύσταση Γενικής Πολιτικής 16 της Ευρωπαϊκής Επιτροπής κατά του Ρατσισμού και της Μισαλλοδοξίας (ECRI) και να αποφύγουν την ποινικοποίηση της παροχής κοινωνικής και ανθρωπιστικής βοήθειας σε παράτυπους μετανάστες. Greece: Judicial harassment of migrants’ rights defenders Panayote Dimitras and Tommy Olsen

View in browser © Egor Myznik / Unsplash Greece: Judicial harassment of migrants’ rights defenders Panayote Dimitras and Tommy Olsen The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the judicial harassment of Mr Panayote Dimitras and Mr Tommy Olsen in retaliation for their work defending migrants’ rights. Mr Dimitras is the GHM co-founder and spokesperson, and a member of the OMCT’s General Assembly. Mr Olsen is the founder of Aegean Boat Report, a Norwegian NGO founded in 2018 that monitors the attempts of migrant individuals to cross the Aegean Sea, as well as the human rights violations committed against them, including illegal pushbacks. On December 20, 2022, Panayote Dimitras appeared for interrogation before the Investigating Judge of the Kos Court of First Instance in the framework of a criminal case opened against him. He is accused of “forming or joining for profit and by profession a criminal organisation with the purpose of facilitating the entry and stay of third country nationals into Greek territory” under Articles 1, 12, 13(e), 14, 16, 17, 18, 26(a), 27, 45, 50, 51, 52, 53, 57, 79, 80, 94, 187 para. 1 of Law 4251/2014, also called Immigration and Social Integration Code. Panayote Dimitras has been banned from carrying out any of GHM’s activities as a preventive measure pending trial. The prosecutor further requested house arrest for Mr Dimitras, while the investigative judge requested a ban on leaving the country, a 10,000 Euro bail, and by-weekly reporting to the police. A judicial council will arbitrate the remaining preventive measures to be imposed on Mr Dimitras in the upcoming days. The Investigative Judge of Kos has opened a criminal investigation into Mr Tommy Olsen’s human rights activities in the framework of the same criminal case. The indictment bill issued by the Investigative Judge of Kos against Panayote Dimitras mentions that Tommy Olsen would have “facilitated the entry and residence of third country nationals into Greek territory” in cooperation with Mr Dimitras and two alleged human traffickers. The indictment further states that Mr Olsen would have sent a “message via e-mail to the Greek authorities including the details of the third country citizens, as well as their location in order for them to join the asylum procedures”. At the time of publication of this Urgent Appeal, Tommy Olsen had not received any official information about the criminal investigations and cases initiated against him. These accusations relate to the alerts issued by Mr Dimitras to the Hellenic Police, the Coast Guard, the Greek migration authorities, the UN Refugee Agency in Greece and the Greek Ombudsman about the arrival of migrant individuals in the Greek islands of Kos on July 13, 2021. Mr Dimitras sent several emails to the above-mentioned authorities listing the names and nationality of the migrant individuals traveling on floating boats towards Greece in order to apply for asylum. In his emails, Mr Dimitras explicitly mentioned that the migrant individuals had contacted GHM to alert the organisation about their situation, that is, their presence on the islands, as well as their wish to apply for asylum. The case file includes details about the Investigating Judge of Kos’ request to the Investigating Judge of Lesbos to provide information about a second criminal investigation against Tommy Olsen, as well as humanitarian and health care workers Ms Madi Williamson and Ms Ruhi Loren Akhtar, for “facilitating the illegal entry of foreigners into Greek territory through the Northeastern islands of the Aegean Sea”. None of them have been officially notified about this case. The Observatory recalls that on October 10, 2022, Greece’s largest national newspaper Kathimerini, published leaked information about two criminal investigations and subsequent criminal cases allegedly filed against Panayote Dimitras and “a national of a Northern European country” on charges of “facilitating the entry of third country nationals into Greek territory” under Law 4251/2014 of Greece. The article did not mention Mr Dimitras’ name explicitly but used vague terms to describe him, including “the head of a human rights NGO” or “Greek head of the NGO. According to the newspaper, the investigations were initiated by the Greek Coast Guard jointly with the National Intelligence Service and were subsequently submitted to “the relevant prosecutor’s office”. The article further stated that the two criminal cases were at the hands of the investigating judge in the city of Kos. Panayote Dimitras did not receive any official information about the criminal investigation and case initiated against him until November 18, 2022, and was given access to the case file only on December 9, 2022. The Observatory strongly condemns the judicial harassment and smear campaigns against Panayote Dimitras, Tommy Olsen, Madi Williamson, Ruhi Loren Akhtar and all migrants’ rights defenders in Greece, as well as the ongoing denial of rights to migrants and their subsequent exposure to torture and ill-treatment in the context of collective and illegal expulsions. Non-governmental organisations that work on migrants’ rights play an essential role to defend the human rights of people on the move in a context of systematic violations of international human rights standards by the Greek authorities, including illegal pushbacks and collective expulsions of migrants, as denounced in 2020 by the UN Committee Against Torture (UNCAT).The Greek state has consistently failed to submit the information concerning the alleged intimidation and harassment of human rights defenders and humanitarian workers and volunteers that was required by the UNCAT. Yet, migrants’ rights defenders have been heavily criminalised for years. View in browser Greece: Smear campaign against Panayote Dimitras for defending migrants’ rights The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the smear campaign in Greek media against Mr. Panayote Dimitras, as well as about the potential criminalisation he faces. Mr Dimitras is the GHM co-founder and spokesperson, and a member of the OMCT’s General Assembly. On October 10, 2022, Greece’s largest national newspaper Kathimerini, published an article in both English and Greek untitled “The Turkish coast guard and the activist: Trafficking ring with Greek connections”, revealing the alleged involvement of human rights defenders in migrant trafficking into East Aegean Islands. Using vague descriptions, including “the head of a human rights NGO” or “Greek head of the NGO”, to avoid an explicit mention of Mr Dimitras’ name, the article reveals two criminal investigations and subsequent criminal cases allegedly filed against him and “a national of a Northern European country” on charges of “facilitating the entry of third country nationals into Greek territory” under Law 4251/2014 of Greece. On July 13 and August 24, 2021, Mr Dimitras alerted the Hellenic Police, the Coast Guard, the Greek migration authorities, the UN Refugee Agency in Greece and the Greek Ombudsman about the arrival of migrant individuals in the Greek islands of Kos and Farmakonisi. Mr Dimitras sent several emails to the above-mentioned authorities listing the names and nationality of the migrant individuals traveling on the boats who wanted to apply for asylum in Greece. In his emails, Mr Dimitras explicitly mentioned that the migrant individuals had contacted the GHM to alert the organisation about their situation, that is, their presence on the islands, as well as their wish to apply for asylum. However, Kathimerini’s article portrays Mr Dimitras’ legitimate defence of human rights, and particularly, migrants’ rights, as alleged acts of human trafficking. According to the newspaper, Mr Dimitras and the other individual would have cooperated with the Turkish Coast Guard to bring migrant individuals to Greece, by exchanging “information on the time of departure of the journey, the itinerary and the time of their arrival on the Greek islands”. The evidence to prove the involvement of Mr Dimitras into this alleged crime, according to the article, are the above-mentioned emails. The article further mentions that a Cameroonian national and alleged human trafficker traveling on the inflatable boat on July 13, 2021, would have contacted Mr Dimitras on the same day to inform him about the details of the trip. This individual was in fact an asylum seeker who was arbitrarily arrested by the Greek authorities after the BBC published on July 13, 2021 a short report in which the Cameroonian man narrated as an eye-witness and survivor, a previous push-back of migrants in Greek waters. The investigations into the above-mentioned alleged acts of human trafficking, according to the newspaper, were initiated by the Greek Coast Guard jointly with the National Intelligence Service and were subsequently submitted to “the relevant prosecutor’s office”. The article states that the two criminal cases are at the hands of the investigating judge in the city of Kos. At the time of publication of this Urgent Appeal, Mr Dimitras had not received any summons to a preliminary investigation nor official information about the alleged criminal investigations and cases initiated against him. The Observatory strongly condemns the smear campaign against Mr Dimitras and all migrants’ rights defenders in Greece, as well as the ongoing denial of rights to migrants and their subsequent exposure to torture and ill-treatment in the context of collective and illegal expulsions. Non-governmental organisations that work on migrants’ rights play an essential role to defend the human rights of people on the move in a context of systematic violations of international human rights standards by the Greek authorities, including illegal pushbacks and collective expulsions of migrants, as denounced in 2020 by the UN Committee Against Torture (UNCAT).The Greek state has consistently failed to submit the information concerning the alleged intimidation and harassment of human rights defenders and humanitarian workers and volunteers that was required by the UNCAT. Yet, the situation of migrants’ rights defenders has been critical for years. The Observatory for the Protection of Human Rights Defenders, a partnership of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your intervention in the following situation in Greece.

Description of the situation:

The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the judicial harassment and upcoming trials against Mr. Panayote Dimitras, GHM co-founder and spokesperson, and member of the OMCT’s General Assembly.

Panayote Dimitras will face three trials before the Three-Member Misdemeanours Court of Athens on September 7, and October 6 and 10, 2022, on charges of “false accusation” and –in two of them- “aggravated defamation” (Articles 229 and 363 of the Criminal Code of Greece, respectively). If convicted and sentenced for all charges, he would face up to 7 years of imprisonment and a fine up to 15,000 euros.

The first trial against Mr. Dimitras is related to a complaint of “public incitement to violence or hatred” he filed in November 2017 before the Public Prosecutor’ s Office at the Athens Court of First Instance against Mr. Kostas Katsikis, then Member of the Greek Parliament for the extreme-right party Independent Greeks. According to Mr. Panayote Dimitras’ complaint, Mr. Katsikis made a racist, homophobic and transphobic speech during a parliamentary debate on December 12, 2016. On February 2019, Mr. Katsikis filed a complaint of “false accusation” and “aggravated defamation” against Mr. Dimitras before the Public Prosecutor’ s Office at the Athens Court of First Instance. It is in relation to this complaint by Mr. Katsikis that Mr. Dimitras will be tried on September 7, 2022.

The second trial against Mr. Dimitras is related to a complaint of “violating the Law on Combatting Racism and Xenophobia” he filed in December 2018 before the Department for Combating Racist Violence (Attica Division) of the Hellenic Police against musician and actor Mr. Yannis Zouganelis. According to the complaint, Mr. Zouganelis made racist comments against Greece-based migrants in a statement he made on TV on December 19, 2018. On March 26, 2019, Mr. Zouganelis filed a complaint against Panayote Dimitras for “false accusation” and “aggravated defamation” before the Public Prosecutor’ s Office at the Athens Court of First Instance. It is in relation to this complaint by Mr. Zouganelis that Mr. Dimitras will be tried on October 6, 2022.

Finally, the third trial against Mr. Dimitras is related to a complaint of “violating the Law on Combatting Racism and Xenophobia” he filed in December 2018 before the Department for Combating Racist Violence (Attica Division) of the Hellenic Police against Mr. Christos Kalyviotis, Mayor of Limni – Mantoudi – Agia Anna. According to Mr. Dimitras’ complaint, Mr. Kalyviotis equated asylum seekers and refugees to criminals in December 13, 2018. On April 22, 2019, Mr. Kalyviotis filed an oral complaint at a local police station for “false accusation” and “aggravated defamation” against Panayote Dimitras. The complaint was transferred to the Public Prosecutor’ s Office at the Athens Court of First Instance on July 16, 2019, and a preliminary investigation was opened on January 8, 2020. It is in relation to this complaint by Mr. Kalyviotis that Mr. Dimitras will be tried on October 10, 2022.

The Observatory recalls that it is not the first time Panayote Dimitras faces judicial harassment and other acts of reprisals in retaliation for his legitimate human rights work, including acts of intimidation and unfounded accusations. On February 15, 2022, Mr. Dimitras and Ms. Andrea Gilbert, GHM specialist on anti-Semitism, were sentenced to a twelve-month prison sentence suspended for three years on the charge of “false accusation” in relation to a complaint for “public incitement to violence or hatred” and “abuse of ecclesiastical office” they filed in April 2017 against the Metropolitan Bishop of Piraeus Seraphim.

The Observatory further recalls that the situation of human rights defenders in Greece has been critical for years. Human rights defenders are consistently targeted for their legitimate work and face different types of attacks, including surveillance, judicial harassment, arbitrary arrests, detentions, ill-treatment, entry bans and expulsion.

The Observatory expresses concern over the judicial harassment against Panayote Dimitras and urges the Greek authorities to respect his rights to due process and fair trial, and to ensure that an end is put an to all acts of harassment, including at the judicial level, against him, as well as all other human rights defenders in the country.

1. Guarantee, in all circumstances, the physical integrity and psychological well-being of Mr. Panayote Dimitras;
2. Ensure that an immediate end is put to all act of harassment, including at the judicial level, against Mr. Panayote Dimitras and Ms. Andrea Gilbert, as well as against all human rights defenders in Greece.
